1. Service Provision

  • Starlings agrees to provide internet services to the customer according to the terms specified in the service plan.

  • The services may include broadband internet access, fixed-line internet, Wi-Fi, and other associated services like email, cloud storage, and VoIP.

  • Starlings will outline the available plans (e.g., data limits, speeds, subscription fees) and any associated terms.

2. Subscription Plan

  • The customer subscribes to a particular service plan, which will specify the service speed, data limits, pricing, and duration.

  • Starlings may offer various subscription packages, which can be monthly, quarterly, or annual, based on customer preferences.

  • If a customer opts for a long-term contract (e.g., 12 months), early termination fees may apply.

3. Billing & Payments

    Payment Methods

  • Payment methods typically include bank transfer, debit/credit cards, UPI, and other online payment methods.

    Payment Frequency

  • Payments may be required for monthly, half yearly, or annual billing cycles depending on the subscription plan chosen by the customer.

  • Customers are responsible for ensuring timely payment according to their chosen cycle to avoid service interruptions.

    Subscription Renewal

  • Renewal notices are sent to the customer before the end of the current billing cycle.

  • Starlings will charge the applicable fee for the next billing period unless the customer opts for cancellation.

     GST and Taxes

  • All applicable taxes (such as Goods and Services Tax – GST) will be charged in accordance with current Indian tax laws.

  • The customer will be notified of the applicable tax rate at the time of payment, and the total charge will include the base price along with applicable taxes.

    Indemnity and Liability

  • Starlings is not liable for any issues caused by third-party payment gateways or external technical issues.

  • Starlings liability is limited to the amount paid for the specific transaction or service under dispute.

    Third-Party Service Providers

  • Starlings may use third-party payment processors for online transactions, and these third parties will handle payment processing. The Starlings is not responsible for issues arising from these third-party services.

4. Service Availability

  • Starlings will provide the service within the specified geographic area (e.g., city, region).

  • Service availability may depend on technical and infrastructure limitations, and the Starlings may not be responsible for outages due to reasons beyond their control (e.g., natural disasters, power failures).

  • Starlings typically do not guarantee 100% uptime but may offer Service Level Agreements (SLAs) with uptime commitments.

5. Service Suspension or Termination

  • Starlings has the right to suspend or terminate service if the customer fails to pay for the service on time, violates the terms of use, or engages in illegal activities.

  • Customers may request service termination, but certain fees or penalties could apply, especially if the service is terminated before the end of the contract period.

  • If the service is suspended or terminated due to non-payment or other breaches, the customer may be required to pay any outstanding fees before service restoration.

6. Fair Usage Policy (FUP)

  • Starlings enforce a Fair Usage Policy (FUP) to ensure that no customer uses an excessive amount of data or bandwidth that could affect the overall performance of the network.

  • FUP typically limits the maximum data usage or speed for a given plan. After the data cap is reached, the Starlings may reduce the customer’s speed, charge for additional data usage, or restrict services.

  • FUP details are usually provided by the Starlings at the time of plan selection.

7. Data Privacy and Security

  • Starlings is obligated to protect the customer’s personal data and usage information in accordance with the Information Technology Act, 2000, and applicable privacy laws.

  • Customer data should be encrypted, stored securely, and not shared with unauthorized third parties.

  • The customer agrees to the collection and use of data for billing purposes, service improvement, and compliance with legal requirements.

  • Starlings may also have access to browsing history or network traffic, but this is generally governed by privacy policies and applicable regulations.

8. Customer Responsibilities

  • The customer is responsible for providing accurate details (name, address, payment information) and ensuring proper usage of the services.

  • The customer must comply with the Starlings Acceptable Use Policy (AUP), which typically prohibits activities like:

    • Illegal activities (e.g., hacking, fraud)

    • Spamming

    • Distribution of malicious software or viruses

    • Infringement of intellectual property rights (e.g., pirated content sharing)

  • The customer is responsible for ensuring that the device used to connect to the Starlings network is secure.

9. Installation and Maintenance

  • Starlings will provide installation of the internet service at the customer’s location, which may involve the provision of necessary equipment (e.g., modem, router).

  • Installation fees may apply, and the customer must ensure the Starlings technician has access to the premises for setup.

  • Starlings may provide maintenance services and repair support for faults or issues with the service. However, the customer is generally responsible for maintaining their own equipment (like routers, personal computers).

10. Customer Support

  • Starlings has customer support services for troubleshooting, billing issues, technical assistance, and general inquiries.

  • Support may be available via phone, email, chat, or through a self-service portal.

  • In case of issues, customers are advised to report them immediately to minimize disruption to their service.

11. Dispute Resolution

  • If a dispute arises between the Starlings and the customer, both parties are encouraged to resolve it amicably.

  • If the issue cannot be resolved through direct communication, the customer may escalate the dispute to a relevant regulatory authority, such as the Telecom Regulatory Authority of India (TRAI).

  • The terms may specify the procedure for formal dispute resolution through arbitration or legal channels.

12. Amendment of Terms

  • Starlings reserves the right to amend or modify the terms and conditions from time to time.

  • Customers will be notified of any significant changes through email or SMS.

  • If the customer does not agree with the new terms, they may have the option to discontinue the service.

13. Limitation of Liability

  • Starlings liability is generally limited to the amount paid by the customer for the specific service during the billing cycle in question.

  • Starlings is not liable for damages resulting from service interruptions, delays, or issues outside their control, such as third-party service failures or force majeure events.

14. Force Majeure

  • Neither party is liable for any failure or delay in service due to causes beyond their control, such as natural disasters, strikes, government actions, or technical issues with infrastructure.

15. Governing Law

  • The agreement is governed by the laws of India, and any disputes will be subject to Indian courts, typically in the jurisdiction where the Starlings is registered or where the customer resides.

16. Acceptance of Terms

  • By subscribing to the Starlings services and using their platform, the customer agrees to abide by the terms and conditions outlined in the agreement.
